Terms and Conditions of online shop WOOD FOR GUITAR

- §1
Preliminary provisions
- The online Shop WOOD FOR GUITAR, available at www.woodforguitar.com, is run and managed by TOMASHEK Tomasz Wojtowicz, entered in the CEIDG in Poland, NIP 8941835787, REGON 931193685, EU VAT ID PL8941835787.
- These Regulations are addressed to the Shop's Clients and define the rules of using the online Shop as well as the rules and procedure of concluding Sales Contracts at a distance through the Shop.

Definitions
- Consumer - a natural person entering into an agreement with the Seller within the framework of a Store, whose subject matter is not connected directly with any business or professional activity.
- Entrepreneur - a natural person, legal person and organizational unit not a legal entity whose separate statute grants legal capacity to carry out on its own behalf the economic activity which uses the Store.
- Client – every Consumer and Entrepreneur making purchases through the Store.
- Seller - natural person running a business under the name TOMASHEK Tomasz Wojtowicz, entered in the Central Register and Information on Business Activity (CEIDG) in Poland, NIP 8941835787, REGON 931193685, EU VAT ID PL8941835787.
- Shop, Store – online shop, available at www.woodforguitar.com, run and managed by the Seller.
- Product - available item that is the subject of the Product Sales Agreement between the Client and the Seller.
- Shopping Cart, Cart - a module in the structure of the Shop, where the Client can see selected Products, with the possibility to set and modify the Order data, including quantity of Products.
- Order form, Purchase form - an interactive form available at the Store enabling the Client to place an Order, including by adding the Products to the Cart, defining the terms of the Product Sales Agreement, including the manner of delivery and payment.
- Order, Purchase - a voluntary statement of the will of the Customer made using the Order form and directing directly to the Product Sales Agreement with the Seller.
- Sales Agreement, Product Sales Agreement - the contract for the sale of the Product concluded between the Client and the Seller via the online Shop.
- Remote contract, Remote Sales Agreement - agreement concluded with the Client within the framework of the organized system of contracting distance contracts within the Shop, with the exclusive use of distance communication (Internet, telephone).
- Account - a Client's account at the Store, where the information provided by the Client is collected voluntarily and information about the orders placed in the Store, possibly also bonus points, loyalty programs (if applicable) and other information to facilitate the purchase, as well as moving within the structure of the Store.
- Registration form - a form available in the Shop to create an Account.

- Contact with the Seller is possible through the addresses and telephone number listed in this paragraph.
- Seller responds to e-mail at max time 48 hours.
- Client may contact the Seller by phone from 8:00 to 16:00 Polish time, Monday through Friday, except holidays in Poland.
- Shop does not sell direct and does not have a specific place of sale in the sense of geographical location.

Technical requirements
To use the Store, including viewing the store's assortment and ordering and purchasing, Customer will need:
- a terminal device with active Internet access and an up-to-date web browser,
- active email account (e-mail),
- enabled cookies,
- possibly other typical companion programs, eg FlashPlayer

General informations
- Seller to the fullest extent permitted by law shall not be liable for disruption or interruption in operation of the Store due to force majeure, unauthorized acts of third parties, technical failures, to which Seller has no influence or partial or total incompatibility of the online Shop with Customer's technical infrastructure.
- Browse the Shop assortment is possible without the need to set up an Account. Placement of orders by the Customer for Products in the assortment of the Shop is possible either after the establishment of the Account in accordance with the provisions of § 6 of the Regulations or by providing the necessary personal and address data to enable the Order, without setting up un Account.
- The prices quoted in the Shop are in Polish Zlotys and are gross prices (include VAT in force in Poland). In this case, the symbol of the Polish currency PLN, or the commonly used "zł" symbol, is immediately followed by the value of the price. After selecting a different language version of the Store and / or another currency, the quoted prices are also gross (include VAT in force in Poland), and with the value of the quoted price there is the symbol of the settlement currency in the applicable international standard, eg EUR, USD.
- The total amount to be paid by the Customer shall consist of the price of the Product or Products and the cost of delivery (including packaging and shipment), to which the Customer is informed on the Store's website during filing Order form, and also at the time of expressing the will of the Product Sales Agreement.
- Where the nature of the subject-matter of the Agreement does not permit early calculation of the final price, the manner in which the price will be calculated, as well as packaging, transport, delivery, postal and other costs will be indicated in the Store in the Product description.

Setting up an Account
- To sign up for a Store Account, Client must complete the Registration form. The following information is required: (name of the company), name and surname, e-mail address, contact telephone number, delivery / residence address, (EU VAT ID if required).
- Account creation in the Store is free of fees.
- Logon to the Account is done by entering the login email address (which will also be the contact address of the Client) and the password established in the Registration form or subsequent changes made in the Account settings.
- The Client shall have the opportunity at any time, without giving any reason and without any charge, to delete the Account by his own action or by sending a reasonable request to the Seller.

Rules for placing Orders in the Shop
To place an order:
- Log in to the Store (this is not mandatory)
- Select the Product that is the subject of the Order, and then click the "Add to Cart" button. In the same way, Client must purchase another Product or Products
- Log in to Client Account or use the opportunity to place an Order without registering and logging in
- If not logged in - fill in the Order Form by entering the details of the Order Recipient / the address at which the Product or Products will be delivered, select the type of shipment (delivery method), enter the required Invoice or Receipt Sales document
- Click the "order and pay" or equivalent button, redirecting to the delivery and payment selection form
- Select one of the available delivery methods (depending on the option available, the delivery cost will be included) and payment and depending on the method of payment, pay the order within the specified time.

Delivery and payment methods
- Depending on the type and quantity of goods, the Customer may use the following delivery methods:
- Postal delivery (if available)
- Courier delivery
- The customer can use the following payment methods:
- Payment by bank transfer to Seller account
- Electronic payments through an electronic payment intermediary - Platnosci Shoper, or Dotpay, or PayPal Express Checkout. The online payment service "Platnosci Shoper" is electronically hosted by Blue Media S.A. Online payments e-transfers made through Dotpay are conducted through Dotpay.com
- Payment by credit card, through a merchant payment intermediary, Platnosci Shoper, or DotPay, or PayPal Express Checkout. The online payment service "Platnosci Shoper" is provided byBlue Media S.A. And the types of cards that can be paid through Platnosci Shoper are Visa, Visa Electron, MasterCard, MasterCard Electronic, Maestro. Dotpay credit card transactions are conducted through Dotpay.pl, and the types of cards that can be paid through Dotpay include: Visa, Visa Electron, MasterCard, MasterCard, Maestro.
- General or detailed information on payment methods and acceptable payment methods are also provided on the Shop information pages at www.woodforguitar.com. Payment options are always available for the Buyer to choose when making a payment.
- In the event of a need for return of funds for a transaction made by the Client, the Seller will return the funds using the same methods of payment as the Customer used in the original transaction, and in the event that the Client paid for the transaction with a payment/credit card, the Seller will return the funds to the Client’s bank account assigned to the card.

Execution of the Contract of Sale, the Product Sales Agreement
- The conclusion of the Sale Agreement between the Client and the Seller shall be made after the Customer submits the Order by means of the Order form in the online Shop pursuant to § 7 of the Terms and Regulations.
- After the Order is placed, the Seller immediately confirms receipt of the Order and at the same time accepts the Order for execution. Confirmation of receipt of the Order and its acceptance is effected by sending the Seller a suitable e-mail to the Customer's e-mail address, which contains at least the Seller's statement of receipt of the Order and its acceptance for execution and confirming the conclusion of the Sale Agreement. Upon receipt of the above email, the Customer agrees to the Product Sales Agreement between the Customer and the Seller.
- If Consumer chooses: A - payment by online transfer, electronic payment or payment by credit card, the Customer is obliged to make payment within 3 calendar days from the date of conclusion of the Contract - otherwise the order will be canceled, B - payment by bank transfer, the Consumer is obliged to make payment within 3 business days from the date of conclusion of the Contract - otherwise the order will be canceled
- If the Customer chooses a delivery method other than personal pickup, the Product or Products will be dispatched by the Seller within the time specified in its description (subject to paragraph 5 of this paragraph), as selected by Customer during the Order.
- A - In the event of the order Products with different delivery dates, the delivery date is the longest set delivery date. B – In the event of the order Products with different delivery dates, Consumer has the option of requesting delivery of Part of Purchased items or delivery of all Products upon completion of the entire order.
- The beginning of the period of delivery of the Product to the Customer counts as follows: A - in the event of the choose to pay by credit card – from the date of confirmation of payment, B - in the event of the choose to pay by bank transfer, electronic online payment - from the date of income to the bank account of Seller.
- Deliveries take place in all regions and countries of the European Union covered by the postal or courier company delivering the goods with which the Shop cooperate. Most European countries have setted fees for delivery and delivery method can be selected by the Consumer during purchasing the Order. In the other events, the Seller gives the delivery cost on request.
- Delivery of the Product or Products to the Customer is payable unless the Sales Contract provides otherwise. Shipping cost of the Product or Products (including packaging, shipping, delivery and postal charges) is indicated during the Order submission process. In special cases, delivery cost is on request (but always before the purchase decision has been made by the Customer, before payment is made). These specific cases are appropriately marked in the Store, for example, purchases of products in oversized, delivery to places not covered by standard rates for transportation by postal or courier companies.
- §10
Right of withdrawal
- The Consumer may, within 14 days, withdraw from the Contract of Sale without giving any reason.
- The period referred in 1 begins with the date of delivery of the Product to the Consumer or a person designated by him other than the carrier.
- In the case of an Agreement that covers a number of Products, which are supplied separately, in lots or in parts, the period indicated in 1 runs from the delivery of the last item, batch or part.
- The Consumer may withdraw from the Agreement by submitting a statement of withdrawal to the Seller. It is enough to send a statement by the Consumer before the expiry of the deadline.
- A statement may be sent by traditional mail, by electronic means, by sending a statement to the Seller's e-mail address or by making a statement on the Seller's website - Seller's contact details are set forth in § 3.
- If the Consumer sends a statement by electronic means, the Seller will immediately send the Consumer to the e-mail address provided by the Consumer confirming receipt of the withdrawal declaration.
- Consequences of termination: A - In the event of termination of the Contract concluded at a distance, the Contract shall be deemed not to be, B - In the event of withdrawal from the Agreement, the Seller shall return the Consumer immediately, no later than within 14 days of receiving the consumer's statement of withdrawal, all payments made by him or her, including the delivery cost of the item/s.
- Return of the payment will be made by the Seller using the same payment methods as used by the Consumer in the original transaction, unless the Consumer expressly agrees to another solution that will not involve him with any additional costs. In case the Customer pays for the transaction with a payment/credit card, the Seller returns funds to the bank account assigned to the customer's card.
- Seller may withhold repayment until the Product has been returned or until proof of return is provided to him.
- The Consumer should return the Product to the Seller's address given in these Terms and Regulations immediately, no later than 14 days from the date he or she informed the Seller of the withdrawal of the Contract. Term will be retained if the Consumer returns the Product within 14 days.
- The Consumer bears the direct cost of returning the Product.
- The Consumer is only liable for a reduction in the value of the Product resulting from its use other than as necessary to establish the nature, characteristics and performance of the Product.
- The right to withdraw from a distance Contract is not available to the Consumer in respect of the Agreement:
- where the subject of the offer is an unconventional item, manufactured according to the Consumer's specifications or created to satisfy its individual needs,
- where the item is provided in a sealed package which can not be returned for health or hygiene reasons after opening the package,
- in which the subject matter is a thing that is quickly spoiled or has a short shelf life,
- for the provision of services, if the Seller has performed the full service with the express consent of the Consumer, who has been informed by the commencement of the service that, upon fulfillment of the performance by the Seller, he will lose his right to withdraw from the Contract,
- where the price or remuneration is determined by fluctuations in the financial market over which the Seller does not exercise control and which may occur prior to the expiration of the period for withdrawal,
- the subject matter of which is the supply of goods, which, by their nature, are inseparably linked to other goods

Complaints and Warranties
- The Sales Agreement covers new and used Products. If the offered product is used, the status of each Product that is used is described in the Store, and the description of the Product is described in detail. If the product description does not contain "used product" information - this means that the Product is new.
- The Seller is obliged to provide the Customer with a fault-free item. Natural Products (such as wood) have the natural features such as: knots, overgrowth, discoloration, mineral clusters, lack of reproducibility and appearance, pores, natural gaps and micropores, irregular fiber orientation, shape change in climatic conditions, in particular changes in humidity and / or temperature. These natural features of wood are not classified as defects.
- In the event of a defect of the goods purchased from the Seller, the Customer has the right to complain based on the provisions of the Civil Code.
- Complaints should be submitted in writing or by electronic means to the Seller's address specified in these Regulations or using the electronic complaint form provided by the Seller on one of the Shop pages (if avaliable).
- It is recommended that in the complaint include, among others, a brief description of the defect, the circumstances (including the date of its occurrence), the details of the complaining customer and the customer's request for defect of the goods.
- The Seller will respond to the claim without delay, no later than 14 days, and if he fails to do so within this period, the Customer is deemed to have justified the claim.
- Goods sent in the complaint procedure should be sent to the address given in § 3 of these Regulations.
- In the event that the Product has been granted a warranty, information about it, and its content, will be included in the description of the Product in the Store.

Personal data in the Shop
- The Client’s personal information collected through the online Shop is managed by the Seller. The person acting as Data Protection Officer (DPO) is Tomasz Wojtowicz, who can be reached at the following e-mail address:woodforguitar@gmail.com, tel. +48/ 882803692
- Customers' personal data collected by the administrator via the online Store are collected for the purpose of implementing the Sales Agreement based on the acceptance of the Regulations, which constitutes a specific contract (Article 6 paragraph 1 letter B of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (GDPR)), and if the Customer consents to this – also for marketing purposes (pursuant to Article 6 letter A of the GDPR, data may also be processed for the purpose of sending commercial and informational information by electronic means or by telephone for direct marketing purposes, provided that the Customer gives separate appropriate consent. In the case of additional consent, based on Article 6 letter A of the GDPR – data may also be processed for the purpose of sending marketing information regarding services or products of other entities by telephone, electronically or on paper, depending on the consent given.
- The Customer's correspondence address may be used for the purposes of direct marketing of the relevant controller's products or services, conducted in paper form, and this does not require consent (on the basis of "legitimate interest", as set out in Art. 6 letter F of the GDPR).
- The newsletter, managed by TOMASHEK Tomasz Wojtowicz, may be another purpose of processing the Customer's data if the Customer has given appropriate consent to receive it.
- The recipients of personal data of Customers of the online Store are: A - Broker / intermediary in delivery of the shipment to the Client - in case the Customer uses the Internet Shop on the way of delivery by post mail or courier. The Administrator then gives collected personal data of the Customer to the selected carrier or the intermediary executing the shipment of the order, B - Intermediary / Intermediary servicing the method of payment chosen by the Client - for a Customer who uses the Internet Shop through electronic payment or payment card. The Administrator then gives the collected personal information of the Customer to the selected entity handling those payments in the online Shop.
- The Client has the right to access their data and to correct, delete, restrict, transfer, object, and withdraw consent to their processing at any time, without affecting the legality of processing based on consent before its withdrawal. If it is determined that the processing of personal data violates the provisions of the GDPR, the Client has the right to lodge a complaint with the President of the Personal Data Protection Office. Requests for deletion or correction of data should be sent to the addresses specified in § 3, points 1 and 2 (to be selected).
- Personal data processed for purposes related to the purchase of products and services will be processed for the duration of the purchase and delivery of the product or service, or for the period of actual use of the service. Data subject to archiving will be stored for the period appropriate to the statute of limitations for claims, i.e., a maximum of 10 years. Personal data processed for marketing purposes, covered by the declaration of consent, will be processed until the consent is withdrawn. Personal data processed for the marketing of products and services in paper form, based on a legitimate interest (not requiring consent, pursuant to Art. 6(F) of the GDPR) will be processed until an objection to such processing is filed.
- Providing personal data is voluntary, but failure to provide the personal data specified in the Regulations and required to conclude a Sales Agreement will result in the impossibility of concluding such an Agreement or providing services.
- §14
Final Provisions
- Agreements concluded through the online Store are concluded in Polish, the official language of the Store is Polish. For the English version of the Store, all texts are translated from Polish, which may introduce some inaccuracies.
- Placing an order in the online Store requires prior reading and acceptance of the Regulations by checking the appropriate box confirming reading and acceptance of the Regulations in the order form.
- The Seller reserves the right to make changes to the Terms for important reasons, such as changes in law, changes in payment methods and deliveries - to the extent that these changes affect the implementation of the provisions of these Regulations. The Seller will notify Customer at least 7 days in advance of any change.
- In matters not covered by these Regulations, the Polish law commonly applicable, in particular: the Civil Code; Act on the provision of services by electronic means; Law on Consumer rights, Data Protection Act.
- The Client has the right to use out-of-court complaint and redress procedures. To do this, Client can file a complaint through the EU-based ODR web platform available at: http://ec.europa.eu/consumers/odr/.
